9.  Limitation of Liability. 11.  Waiver. The failure by either party to exercise any right, power or privilege under the terms of this Agreement will not be construed as a waiver of any subsequent or further exercise of that right, power or privilege or the exercise of any other right, power or privilege. 

12.  Remedies and Legal Fees. In the event of a dispute, Buyer’s sole remedy for any and all losses or damages resulting from defective Goods or from any other cause will be for the purchase price of the particular Goods with respect to which losses or damages are claimed, plus any shipping costs paid by Buyer. In the event such dispute results in legal action, the successful party will be entitled to its legal fees, including, but not limited to its attorneys’ fees.

13.  Legal and Binding Agreement. This Agreement is legal and binding between the Parties as stated above and by eBay. Warranty Policy:

• Unless noted above, all items come with a 30-Day Warranty. All parts, labor, tech support, and shipping (UPS pre-paid shipping label) is fully covered. This warranty only covers hardware related issues; software issues due in part to viruses and user changed settings are not covered.
• Any missing items or items not as described must be reported with-in 14 days upon receipt of item. After 14 days we will not be able assist with these issues.
• Unauthorized repair attempts or upgrades will void any and all warranty.
• This warranty is valid only within the 49 continental United States and is not transferable.  If you ship this item outside the continental USA; you are voiding your warranty and we will not assist with any issues.
• Data recovery is not included under this warranty and we are not responsible for data that may be lost or damage during transit or repair.
• We handle all returns with-in 2 business days to ensure you are not without your item for too long.

Refund Policy:

• With-in the warranty period you are allowed to return an item for a refund. A 20% restocking fee will be deducted from your refund to cover all shipping and packaging expenses.
• Any new sealed item returned “opened” will be charged up to a 50% restocking fee. To avoid this fee any new item must be returned still factory sealed.
• If you refuse a package or after the third attempt the package is sent back; we will charge a 20% restocking fee to cover return shipping costs.
• We will not accept any returns after 30-Days for a refund.

• By purchasing this item you accept our policies listed above and below. 
• Each item will be fully inspected upon arrival, any item found with the security seal broken, parts missing, item mishandled, item damaged due to poor repackaging, or we find the issue aroused from a virus or other user use damage will be charged a larger restocking fee.

• BRAND NEW – This item is a brand new item never been used.  Sometimes the packaging might be opened but the item itself has never been used.  This item also might be covered by the manufacture warranty but no guarantees.
• LIKE NEW – This item is not brand new but most likely used.  Item however is in very good condition and might have only been used a couple times.
• REFURBISHED – This item has been fully refurbished by our trained technicians.  Item is run through multiple tests to ensure fully operational.  Item might contain minor scratches/dents but will not affect the item performance.
• TESTED – This item we powered on and were functional / working.  We do moderate testing, there will be no in-depth testing done.
• UNABLE TO TEST – We don’t have the proper test equipment or proper machine to fully test this item.  This item could be working or could NOT.  We do not guarantee this item.  If we are able to, we will power up the item and put the outcome in the description.
• PARTS OR REPAIR – This is an as-is item only.  Assume this item does NOT work and should be bought only for parts or to repair it.  We will not accept returns for ANY reason.  This item carries NO WARRANTY.

SHIPPING & HANDLING

• Free standard ground shipping with-in the continental USA is provided by UPS or USPS at our discretion.  We do offer expedited shipping with UPS 2^nd Day or USPS Priority at additional cost upon checkout.
• For additional costs, all Hawaii/Alaska/PR/USA islands/Military/International orders are only shipped via Priority Mail to ensure safe and guarantee of delivery.  These fees are non-negotiable and are calculated at checkout. 
• If your item arrives damaged, please email us immediately so we can file a claim.  We will need pictures and an accurate description of the damage to item and package.  We will issue a return label and have another item shipped out.  
• Your order will be shipped out with-in 2 Business Days after payment has cleared.
